Your rights as a tenant

Report it

Call 311 or use 311 online for heat, hot water, leaks, mold, pests, peeling paint, broken doors or locks. Ask for an HPD complaint and write down the number.
Be home for the inspection, or arrange access. When an inspector can't get in, violations stay open.
Emergencies: 911. Gas smell: leave first, then call 911 or Con Edison at 1-800-752-6633.

Heat and hot water

Oct 1 to May 31: at least 68°F inside from 6am to 10pm when it's below 55°F outside, and at least 62°F from 10pm to 6am.
Hot water at least 120°F, all year.
Keep a heat log.

Keep proof

Tell the landlord in writing and keep a copy.
Take dated photos and videos.
Keep every notice, receipt and 311 number.

Make them fix it

HP action: you can ask Housing Court to order repairs. Bronx Housing Court is at 1118 Grand Concourse, and the clerk's office helps with the forms.
Right to Counsel: free lawyers for eligible tenants facing eviction. Call 311 and ask for the Tenant Helpline.
Free legal help: Legal Aid Society, Legal Services NYC Bronx, The Bronx Defenders, Mobilization for Justice.
Organize with neighbors: Met Council on Housing, CASA (Community Action for Safe Apartments), Northwest Bronx Community and Clergy Coalition.
Rent-stabilized? NYS Homes and Community Renewal (HCR) takes decreased-services complaints.
Your City Council office can push stuck complaints: find your district.

Retaliation is illegal

Ask Housing Court to order repairs (HP action)

If repairs still don't happen, a tenant or a group of tenants can start an HP case. You do not need a lawyer. Tick items off as you go; ticks are saved only on this phone.

Before you go

Tell the landlord in writing and list every repair. Certified mail gives you proof. Each building page has a letter you can fill in.Call 311 for each problem and save every complaint number.Write down the landlord's name and street address (not a P.O. box). At court

Go to the Housing Court clerk at 1118 Grand Concourse, Bronx, and ask for HP action forms.Serve the papers on the landlord and on HPD exactly as the clerk or judge tells you.The court sends an inspector to your apartment. Be home and ready on that date.On your court date, arrive early: there is a security line.The judge can order the landlord to fix violations by a deadline, with penalties if they don't.
